How does KBC Brussels help guardians?
Being a family or professional guardian is not always a simple matter. It’s imperative that you take good financial care of the ward and do so within the guidelines issued by the justice of the peace.
KBC Brussels ensures that everything is taken care of so that you can focus on performing your financial duties correctly and with peace of mind. This involves taking account not only of your personal situation, but also that of the ward and the decisions of the justice of the peace. For example, we will ensure that the appropriate powers of attorney for yourself and the ward are in place.
More information about guardianship
When an adult can no longer make their own decisions or properly manage their property, the justice of the peace can appoint a guardian who will help the ward make decisions or who will make their own decisions. The judge can either appoint someone from the family or an independent professional guardian, usually a lawyer.
- Collecting information about the ward
- Keeping a record of the financial situation (asset report)
- Preparing reports for the justice of the peace (including on the assets, personal affairs management and living arrangements of the individual)
- Attending to everyday banking and insurance matters for the ward, including making payments, applying for debit cards, taking out insurance and starting or ending investments
- The guardian may open a savings account in the name of the ward
- The guardian may take out home insurance for the ward
In addition, a justice of the peace can give someone under guardianship limited access to their accounts.
The person himself/herself, the family or other stakeholders can submit an application for guardianship to the justice of the peace. Learn more at the Federal Public Service for Justice (in French).
The King Baudouin Foundation has a practical guide for family guardians (in French) which deals with general questions on a range of matters, including the procedure, the implications and your duties.
